Information privacy policies for the www.pierojardinero.com portal
The User and/or Owner of the information, by entering his/her personal data into the www.pierojardinero.com portal (hereinafter the Portal), expressly authorizes PIERO JARDINERO to carry out the processing of his/her personal data in accordance with this privacy policy and in accordance with the provisions of Law 1581 of 2012 and its Regulatory Decree 1377 of 2013 and all the regulations that modify and add to it.
1. Definitions
For the purposes of applying the rules contained herein, the following definitions apply:
- a) Authorization: Prior, express and informed consent of the Owner to carry out the Processing of personal data;
- b) Privacy Notice: Physical, electronic or any other document generated by the Responsible Party that is made available to the Owner for the processing of their personal data. - c) Database: Organized set of personal data that is subject to Processing.
- d) Personal data: Any information linked to or that can be associated with one or more specific or determinable natural persons;
- e) Private data: This is data that, due to its intimate or reserved nature, is only relevant to the owner.
- f) Data Processor: Natural or legal person, public or private, that by itself or in association with others, carries out the Processing of personal data on behalf of the Data Controller;
- g) Data Controller: Natural or legal person, public or private, who by itself or in association with others, decides on the data database and/or the Processing of the data;
- h) Owner and/or User: Natural person whose personal data are subject to Processing;
- i) Processing: Any operation or set of operations on personal data, such as the collection, storage, use, circulation or deletion of the same.
2. General principles for the processing of personal data
The following principles will be complied with in the Processing of Personal Data:
- a) Principle of purpose: The Processing of Personal Data must obey a legitimate purpose that will be informed to the Owner.
- b) Principle of freedom: The Processing of Personal Data may only be carried out with the prior, express and informed consent of the Owner. Personal Data may not be obtained or disclosed without prior authorization, or in the absence of a legal or judicial mandate that relieves the consent of the Owner.
- c) Principle of truthfulness or quality: The information subject to processing must be truthful, complete, exact, up-to-date, verifiable and understandable. The Processing of partial, incomplete, fragmented or misleading data is prohibited.

- f) Principle of security: The information subject to processing must be handled with the technical, human and administrative measures that are necessary to provide security to the records, preventing their adulteration, loss, consultation, use or unauthorized or fraudulent access.
- g) Principle of confidentiality: All persons involved in the Processing of Personal Data are obliged to guarantee the confidentiality of the information, even after the end of their relationship with any of the tasks included in the processing.
3. Processing to which the data will be subjected and its purpose, third parties and links
PIERO JARDINERO may transfer and/or transmit the personal data subject to processing to companies that are part of its business group, that is, to parent companies, affiliates or subsidiaries. We may also provide your information to our agents and subcontractors to assist us with any of the functions mentioned in our Privacy Policy. - e) To evaluate the quality of products or services.

- g) Send to the physical mail, email, cell phone or mobile device, – via text messages (SMS and/or MMS) commercial, advertising or promotional information about products and/or services, events and/or promotions of a commercial or non-commercial nature, in order to promote, invite, direct, execute, inform and in general, carry out campaigns, promotions of a commercial or advertising nature.
- h) Sharing, including the transfer and transmission of personal data to third parties for purposes related to the operation of PIERO JARDINERO.
- i) Respond to legal requirements from administrative and judicial entities.
- j) Share the personal data collected with third parties that have the quality of commercial and/or business allies to be able to offer products and/or services that allow improving the value offer for PIERO JARDINERO’s customers, all of the above in accordance with the provisions of Law 1581 of 2012 and its Regulatory Decree 1377 of 2013. The processing of my personal data may involve the collection, storage, use, circulation, deletion, transmission, transfer and/or reception of data, for the purpose for which they were supplied.
4. Authorizations
The Processing of Personal Data carried out by PIERO JARDINERO, requires the free, prior, express and informed consent of the Owner of said data. PIERO JARDINERO, in its capacity as Data Controller, has had the necessary mechanisms in place to obtain the authorisation of the data subjects, guaranteeing in all cases that it is possible to verify the granting of said authorisation.
Authorisation may be given verbally and/or by means of a physical or electronic document or any other format that guarantees subsequent consultation. In any case, the authorization must be given by the Owner and it must be possible to verify that he/she knows and accepts that PIERO JARDINERO will collect and use the information for the purposes that are made known to him/her for this purpose prior to the granting of the authorization.
By virtue of the above, the requested authorization must include:
- a) Data controller and what data is collected;
- b) The purpose of the data processing;
- c) The rights of access, correction, updating or deletion of the personal data provided by the owner and,
- d) In addition, the Owner will be informed (i) that he/she is not obliged to authorize the processing, and (ii) that it is optional to provide this type of information
5. Rights of the data subject
The Owner may request that his/her personal information not be published or delivered by PIERO JARDINERO to its affiliates and/or subsidiaries, and/or to third parties, by sending an e-mail to the address pierojardinero@gmail.com, in which case PIERO JARDINERO will not publish or deliver such information, except in case it is required by court order or to protect the property rights or any other right or guarantee of PIERO JARDINERO.
The Owner of the personal data contained in our databases will have the right to:
- a) Know, update and rectify your personal data.
- b) To receive a request for authorisation for the processing of their data.
- c) Submit queries, complaints and/or claims related to the processing of your data.
- d) Request proof of the authorisation granted to PIERO JARDINERO for the processing of your personal data.
- e) Request the exclusion of your personal information from the database.
- f) Revoke at any time the authorisation given to PIERO JARDINERO for the processing of your data.
6. Security
The Portal Owner has adopted the legally required levels of security for the protection of Personal Data, and has installed all the technical means and measures at its disposal to prevent the loss, misuse, alteration, unauthorized access and theft of the Personal Data provided to the Portal Owner. However, the User must be aware that security measures on the Internet are not unbreakable.
